Buying a Gun in California - Not as Easy as it Sounds

Buying a gun in California is a process that is regulated by state and federal laws.[1] In California, purchasing a firearm is subject to strict background checks and restrictions, aimed at preventing firearms from falling into the wrong hands. In this essay, we will explore the process of buying a gun in California and the regulations that are in place to ensure that firearms are used responsibly and safely.[2]

The first step in buying a gun in California is to determine if you are eligible to purchase a firearm. In California, you must be at least 21 years of age to purchase a handgun and at least 18 years of age to purchase a long gun. Additionally, you must be a resident of California, and you must not be prohibited from owning a firearm due to a prior criminal conviction, mental illness, or other disqualifying factors.

Once you have determined that you are eligible to purchase a firearm, the next step is to select the firearm that you want to purchase. In California, there are many different types of firearms available, including handguns, rifles, and shotguns. When selecting a firearm, it’s important to consider factors such as the intended use of the firearm, the size and weight of the firearm, and the cost of the firearm.

With the firearm selected, the next step is to visit a firearms dealer to complete the transaction. In California, firearms dealers are required to conduct a background check on all potential firearm purchasers, regardless of whether the firearm is being purchased from a private individual or a firearms dealer. The background check is performed by the California Department of Justice (DOJ) and typically takes several days to complete. The background check involves a review of the purchaser’s criminal and mental health records, as well as a check of the National Instant Criminal Background Check System (NICS) maintained by the FBI. [3]

If the background check reveals that the potential purchaser is prohibited from owning a firearm, the transaction will be denied, and the firearm will not be sold. If the background check is cleared, the purchaser must then complete a Firearm Safety Certificate (FSC) program, which is required for all first-time firearm purchasers in California. The FSC program is designed to educate purchasers on the safe handling and use of firearms, and it must be completed before the firearm can be purchased.

Once the background check has been cleared and the FSC program has been completed, the purchaser must then complete a waiting period before taking possession of the firearm. In California, the waiting period for a handgun is 10 days, and there is no waiting period for a long gun. During the waiting period, the DOJ has the opportunity to complete its investigation and to revoke the clearance if any additional disqualifying information is discovered.[4]

After the waiting period has passed, the purchaser can then take possession of the firearm from the firearms dealer. In California, there are additional restrictions on the sale of firearms, including a ban on the sale of certain types of firearms, such as assault weapons, and a requirement that all firearms be sold with a trigger lock or other locking device.

In addition to the restrictions on the sale of firearms, California also has strict regulations in place for the use and storage of firearms. For example, firearms must be stored in a locked container or with a locking device in place when not in use, and it is illegal to carry a concealed firearm without a valid permit. Additionally, there are restrictions on the use of firearms, including a ban on the discharge of firearms in certain areas, such as within city limits, and a requirement that firearms be used only for lawful purposes.
